Authentic Cuba Travel®- TERMS & CONDITIONS

Operating name. The legal corporate name of our company in Canada is Bella Travel Group Ltd.

Throughout these "Terms and Conditions" the common name of our operations is referred to as Bella Travel Group Ltd., but all references also apply to the following registered trade names (owned by Bella Travel Group Ltd.):

Tour Registration

All participants must register online or by telephone to qualify for a tour.

Tour Deposit

A non-refundable tour deposit of $300 is required at the time of registration. Registrations are processed on a first come, first served basis and subject to availability. Tour deposits will be returned if a tour is cancelled or the dates are changed. Tour deposits are non-refundable but will be honoured for life for your participation (or a person you designate) in one of our tours.

Balance of Payment

Balance of payment is due 60 days prior to departure. Registrations received and confirmed by Authentic Cuba Travel® less than 60 days prior to departure are payable in full at the time of confirmation.

You can pay by personal or company cheque (check), credit card cheque (check), bank draft, counter and officials cheques (checks), and postal money orders. Please, make your cheque (check) payable to:

Credit cards for airline and insurance payments are accepted at no extra charge. We accept the following credit cards: VISA, MasterCard and AMEX.

Missed Payments

Authentic Cuba Travel® reserves the right to deny tour participation to any applicant who misses scheduled tour payments and for applicants whose checks (cheques) are returned NFS, or whose credit cards are declined.

Schedule for Cancellations and Reimbursements

The following schedule for cancellations and reimbursements for on ground tour costs applies. If you purchase travel cancellation insurance and are unable to attend for reason of illness or injury, moneys paid can be claimed and refunded to you depending on the conditions outlined in your cancellation and/or travel interruption insurance policy.

Cancellation 60 to 31 days prior to departure | Loss 50% of ground portion of tour.

Cancellation 30 days or less prior to departure | Loss 100% ground costs (all payments).

Air Ticket Cancellation, Changes and Air Points

Unless otherwise stated all air tickets sold by Authentic Cuba Travel® are not refundable. Air Canada tickets can be used for up to one year on the same route. A change fee applies. Date changes to tickets once issued incur a change fee and are subject to availability of new flight dates. Air Canada tickets often do not qualify for AeroPlan points unless upgraded to a higher ticket class and cost. Ticket quotations are valid for 48 hours unless noted otherwise.

Personal Responsibility Required

We cannot offer refunds for participants who arrive late or depart early from any program, or for no-shows.

Cancellations and Refunds

Authentic Cuba Travel® reserves the right to cancel a tour prior to departure:

1 ) Tour cancellation may result from natural disaster, political, economic or social instability, and acts of war, terrorism or God in Canada, the US, Cuba or neighbouring countries, and

2 ) Tour cancellation as a result of too few participants for a tour program to be viable.

3 ) In the event Authentic Cuba Travel® cancels a tour program for reasons beyond its control that could affect traveler safety and well being, or render travel impractical or impossible, no refunds for any portion of ground costs will be returned after fifteen (15) days prior to scheduled departure.

4 ) In the event Authentic Cuba Travel® cancels a tour program as a result of too few participants all monies collected from clients for ground costs (services while in Cuba) will be refunded. In either case, Authentic Cuba Travel® is not liable or obligated to refund monies paid by tour participants directly (or through Authentic Cuba Travel®) to third parties such as air service providers. Please consider trip interruption and cancellation insurance.

What is Included?

Unless otherwise detailed, your tour or Cuba-side costs include ground transportation and accommodations on the island, all breakfasts, lunches and dinners as noted in your itinerary (unless noted as not included), admissions and entrance fees (unless noted as not included), an expert bilingual guide/translator. Tour prices are based on double room (shared) occupancy. Specific inclusions and exclusions in the itinerary you have purchased will govern in all matters above.

Travel Insurance

Also known as trip cancellation and travel interruption insurance is not included in the tour price, nor does Authentic Cuba Tours accept responsibility for illness or accidents of any kind prior to or during travel to participants. We strongly recommend trip cancellation and travel interruption (where available), as well as extended health insurance. trip cancellation and travel interruption insurance must be purchased at the time of registration or first trip payment. NEW REGULATION

As of May 1, 2010, the government of the Republic of Cuba requires all visitors to have secured and purchased Cuba's approved travelers health coverage before arriving on the island.

Connecting Flights

Authentic Cuba Travel® will gladly assist you with connecting flights to our gateway cities, and extended stays in Cuba. However, we cannot be responsible for connecting flights made independently by participants. We strongly advise against the purchase of add-on flights, non-refundable, advance or seat sale airline tickets before you have been accepted into a tour and we have confirmed your Cuba-portion flight. We cannot be held responsible for missed flights when you book with other airlines or agencies in advance of our confirmation of your last leg to Cuba flight or actual tour participation.

Single Travellers

If you are traveling alone, upon request, we will attempt to assign a roommate for you of your sex and generation. We make every effort to accommodate single travelers seeking roommates, but occasionally we cannot assign a roommate if one is not available. If this is the case you will be required to pay for a single room supplement. We will let you know what options exist in advance of travel.

Changes to an Itinerary

Authentic Cuba Travel® makes every attempt to insure itinerary information is accurate. However, in circumstances beyond our control, changes may occur. We therefore reserve the right to change itinerary, carriers and substitute hotels whenever necessary. We guarantee that where possible, accommodations of similar or superior quality will be used.

United States Citizens and Residents

US residents are warmly welcome to participate in our tours. Licensed US travellers are solely responsible for ensuring the validity of their license. Unlicensed US travellers are solely responsible for any consequences that may arise as a result of Cuba travel. Please, see the website Legal Cuba Travel for details.

Reserved Right to Discriminate and Deny Services

Authentic Cuba Travel® may refuse service to any applicant, registrant or participant whose behaviour in the opinion of its employees or vendors, would likely disrupt or impede the comfortable and enjoyable progress of a group tour, prior to departure and while abroad. In such case, the offending tour participant forfeits any monetary or legal claims against Authentic Cuba Travel®. Such actions, if deemed necessary by Authentic Cuba Travel® or its vendors are never based upon honoured civil and human rights criteria such as sex, race, gender, sexual orientation, country of origin, age, ableness, or spirituality. However the "principle of unfettered freedom of speech," does not apply if exercised and voiced aggressively, in a hostile or repetitive demeaning fashion towards the host country [Cuba], or groups above, and thus would constitute grounds for denial and cancellation of services. It applies to people who don't like Cuba, and who demonstrate intolerance for protected peoples (above). Persons harbouring prejudices against above peoples and Cuba should not attempt to travel with Authentic Cuba Travel® in the first place. This provision is not to be confused with common concerns, questions and trepidations most North Americans have about Cuba as a result of five decades of isolation imposed and disinformation dispatched by the government, its agencies and beneficiaries, and corporate media of the USA. Our tour programs are predicated upon and seek to realize mutual respect, understanding, dialogue, learning and friendship.

Responsibilities on the Part of the Travel Provider

When you book a Cuba tour with Authentic Cuba Travel®, you and those on whose behalf you are booking become party to a contract with Authentic Cuba Travel® and those companies providing the services included in your tour package. We take great care in selecting the suppliers of services (airlines, hotels, ground transportation companies, restaurants, etc.), which together form the travel services you have purchased. We act solely as agents for these suppliers which are independent parties over which we exercise no direct control. We shall not be liable for any claims, losses, damages, costs, expenses, delays or loss of enjoyment of any nature or kind whatsoever, to you or your traveling companions or group members, resulting from the acts, omissions or negligence of anyone other than us or our employees acting properly on our behalf. Air suppliers' liability may also be limited by law, tariffs or conditions on tickets and in particular you should read and understand the limitations of liability set forth in the airline ticket, once delivered to you. If the entire program is cancelled for any reason, participants shall have no claim other than for a full refund (excluding air costs).

Responsibilities and Obligations of the Tour Participant

All tour participants are expected to obey the laws and regulations of Cuba and failure to do so will relieve Authentic Cuba Travel® of any and all obligations it may otherwise have to the offending tour participant. Authentic Cuba Travel® also reserves the right to exclude a tour participant from all or part of a program if the tour participant's conduct before or after departure appears likely to endanger or impede the safe, comfortable or happy progress of a tour. In such case, the offending tour participant forfeits any claims against Authentic Cuba Travel®.

Ground Services in Cuba

We have made every effort to accurately describe the conditions at destination. It is only given for your information and is not part of the travel services included in the price. If you have a problem with the services provided at destination, please contact your Authentic Cuba Tours representative and give notice in writing. If you cannot resolve your problem at the destination, please write to Authentic Cuba Travel® within seven days of your return. Note All hotels undergo routine maintenance and renovations. If we are advised of any significant change, which may affect your enjoyment of the package, we will do our best to inform you in advance.

Cuba Country Conditions and Accommodations

You should be aware that Cuba has particular features, which may or may not appeal to you, including weather, food, water, local customs, etc. Its living standards, practices and conditions with respect to the provision of utilities, services and accommodation at your destination are different. Such standards may or may not be comparable to those you would expect from similar establishments in Canada or the United States.

Information from Website Users

Site users warrant that any personal information you provide to Authentic Cuba Travel® through this site is accurate and true. Conversely Authentic Cuba Travel® guarantees that under no circumstances will it share your personal information with any agency, government, organization or private concern unless absolutely necessary to ensure your safe and efficient travel to and from Cuba. Note It is the responsibility of each participant to properly inform Authentic Cuba Travel® of any medical problems or special dietary requirements on your registration form.

Warranties and Exclusions

Authentic Cuba Travel® attempts to provide on this site information that is as accurate and up-to-date as possible. However, the information on this site is presented "as is." In using this site you accept that Authentic Cuba Travel® makes no warranty regarding the accuracy, currency or fitness of the information contained on this site. Inasmuch as Authentic Cuba Tours may provide links to other sites on the internet, you accept that Authentic Cuba Travel® bears no responsibility for the accuracy of the information presented by linked sites.

Acceptance of Risk

The Traveler acknowledges that the nature of our Cuba tours could be adventurous and may involve a significant amount of risk to Travelers’ health and/or safety. The Traveler hereby assumes all such risk and does hereby release Bella Travel Group Ltd. from all claims and causes of action arising from any damages or injuries or death resulting from these risks inherent in travel, visiting foreign destinations, and participating in adventurous activities such as those included in our Cuba itineraries. Accommodation, transportation, activities and excursions, and other Cuba tour components of Bella Travel Group Ltd. tours will be arranged by Bella Travel Group Ltd. with Cuban or International suppliers local to the region where the tour operates, who may themselves engage the services of local operators and/or sub-contractors. Standards of hygiene, accommodation and transport in Cuba are often lower than comparable standards than what the Traveler may reasonably expect in their home country or region. Bella Travel Group Ltd. at all times endeavors to appoint reputable and competent local Cuban suppliers and to comply with all applicable laws and regulations concerning health and safety in the regions where our Cuba tours operate. The terms and conditions of all suppliers of Cuba tours components will be applicable to the Cuba tour component provided by such supplier and are expressly incorporated into these Terms and Conditions. These may limit or exclude liability of the supplier. The liability of Bella Travel Group Ltd. will not exceed that of any supplier of any Cuba tour component. The components that make up each Cuba tour shall be regarded as having been satisfactorily performed and delivered solely in reference to the regulations and laws concerning health and safety in the applicable jurisdiction where such component is operated.

Limitations to Liability

This disclaimer includes any and all claims arising from the malfunctioning, performance or nonperformance of this site with respect to travel reservations or tour registrations. If, notwithstanding this disclaimer, Authentic Cuba Travel® is found liable for any injury, loss, damage or claim, Authentic Cuba Travel® limits its liability to the amount of fees or service charges paid to us by the claimant.

Discounts

Authentic Cuba Travel® offers travelers a $100 referral discount per person in all our Cuba tours to make it more affordable for friends and families travelling together.

Couples traveling together automatically get a $200 discount ($100 per person).

You will also receive a $100 discount per each person that joins you on the trip. Invite 1 friend to join you and pay $100 less. Invite 2 friends and pay $200 less. Invite 3, and pay $300 less, and so on.

The people that travel with you will be grateful as they will also get an additional $100 per person discount.

For example, if you invite 8 people to join in, you will receive an $800 discount. Your friends also receive a $100 discount per person, for a total group discount of $1,600.

If you happen to recruit 2 more travelers, for a total of 10 people besides you, you will receive a complimentary ground package! Yes, if you are able to recruit 10 travelers, you will pay nothing, cero, nada for your ground package!
